Covenants

A restrictive covenant on your land will not only limit what you can do on it, but will affect its future value. It can also mean unexpected and unwanted surprises. You may find that your neighbours can have a say in whether a development or alteration goes ahead. Worse yet, they may be able to demand a compensation payment to allow you to proceed.  Taking action into your own hands isn’t the answer either as hefty penalties could result. Perhaps the situation is reversed and you have neighbours who are using their land in a way that impacts on you. Frankly you will want to know if there is anything you can do to stop it.

Early assessment and prompt action can make the difference between success and failure. The best option is to discuss how an existing covenant may impact on your plans before you go ahead investing time and money. We’ll check whether the covenant is binding on you and what your neighbour’s rights are. We’ll work closely with you to make your options clear to you and the results you can expect.
