You may be close to someone who is no longer able to make their own decisions, whether through illness, injury or old age, and who does not have either an Enduring Power of Attorney or a Lasting Power of Attorney in place. If decisions need to be made for them, then you will need to consider appointing a Deputy through the Court of Protection.

The Court of Protection is designed specifically to protect those who cannot make decisions for themselves due to mental incapacity. As well as appointing deputies, the Court can deal with important “one-off” questions relating to the vulnerable person’s property and financial affairs, such as tax planning decisions or whether to make a Statutory Will for them. If the need arises, the Court can also make decisions concerning the person’s health and welfare, such as choices of medical treatment.

We have a well-established relationship with the Court of Protection and can take away the stress associated with formal applications.
