Disputes between parents
 

As a parent you naturally want the best for your child, but achieving it may not be a straightforward if you are separated or divorced. Parents can’t always agree about what’s best for their children and disputes arise which can impact on both you and the children. Parents may fundamentally disagree on the welfare of their children; from the parent they live with or have contact with, to the school they attend or whether they can leave the UK on holiday. Where agreement can’t be reached, parents often have to resort to Court action to obtain an Order.

Court Orders

Seeking a Court Oder is sometimes the only available solution for parents.  Our Family team help parents obtain Court Orders for various child welfare issues, including:

  • Parental Responsibility – determines legal rights and responsibilities of parents
  • Residence Order – determines who the child should live with
  • Contact Order – determines the amount of contact with the non-resident parent
  • Specific Issue Order – determines how a specific issue should resolved, such as schooling, medical treatment, religious upbringing, or holidays abroad
  • Prohibited Steps Order – prevents a parent from taking a particular action, such as sending them to a particular school or bringing them up in a particular faith
  • Care Order – where a local authority takes parental responsibility for a child
  • Adoption Order – where a non-biological parent can become a legal parent through adoption
  • Special Guardianship Order – similar to a Residence Order and determines who can decide where a child should live.
