Commercial Agency

A Commercial Agent is an intermediary involved in selling goods commercially on behalf of a Principal. Such a relationship enables a Principal, usually a company, to take advantage of an agent’s local knowledge and established trade connections as well as saving the costs of having to establish its own selling operations.

The Commercial Agency Regulations 1993 govern such a business relationship and could have a far ranging impact if you are an Agent or Principal. In general terms they are little understood, and often parties to such relationships do not even know of their existence, much less the effect that they have.

At Withy King we have extensive experience in advising both Agents and Principals on whether the Regulations apply and, if so, what the impact of the Regulations will be both during the agency contract and upon termination of the agency.   In particular we can advise on an agent’s entitlement to compensation from the principal on termination of the agency and explore the amount of compensation that might be payable.

We have a proven track record in advising both Agents and Principals. We have achieved valuable settlements for our agent clients without the need to issue full court proceedings.
