In recent months Withy King has recovered very substantial sums of damages for clients in a number of cases. Examples include:
- £173,800 A 43 year old man died as a result of a failure to diagnose and treat his cardiac condition. Claims on behalf of his wife and children for their losses resulting from the death.
- £150,000 50 year old man. Negligent prescription of antibiotics, such that the client developed a more deep-seated infection, the treatment for which resulted in balance problems.
- £470,000 89 year old man. Negligent spinal surgery and aftercare, resulting in incomplete tetraplegia.
- £80,000 7 year old child. Delay in diagnosing and treating Ewing's sarcoma, resulting in higher dose chemotherapy treatment and associated infertility as a result. Settled for £80,000 including a sum for loss of marriage prospects.
- £175,000 Our client suffered a leg fracture and was treated in hospital. Unfortunately he contracted an infection in the wound, which was treated incorrectly with an extremely toxic antibiotic. To compound the problem, his doctors did not monitor his bloods and he suffered drug-induced peripheral neuropathy.
- £60,000 recovered for our client who went into hospital to have her first child, but tragically, the birth was badly managed and her baby was stillborn. Both our client and her husband, who witnessed the aftermath of the birth, were traumatised.
- £65,000 recovered in damages. When our client went into hospital, the type of lung cancer he was suffering from was misdiagnosed, and he was given the wrong treatment. The misdiagnosis was only picked up when he was re-admitted to hospital some years later. As a result of the delay, he suffered avoidable complications of radiotherapy, and a stroke.
- £375,000 settlement after a failure to screen for peripheral arterial disease in a patient transferred from Spain with extensive pressure sores led to the below knee amputation of both legs. Proceedings are continuing in Spain.
- £3 million awarded to the parents of a 9 year old boy with cerebral palsy as a result of a failure by doctors to identify significant abnormalities on ultrasound scans during the mother’s pregnancy.
- £11.4 million recovered for a 12 year old girl with cerebral palsy caused as a result of oxygen starvation during labour and delivery.
- £4.4 million awarded to a 12 year old boy with cerebral palsy caused by a failure by doctors and district nurses to refer his mother to hospital when she developed a life threatening condition during her pregnancy.
- £100,000 settlement to client for negligent complications following gynecological surgery resulting in bowel damage, scarring and temporary colostomy.
- £250,000 settlement for catastrophic bowel complications, including multiple fistulas between bowel, bladder and vagina. Long term, temporary colostomy scarring and incisional hernia inoperable due to residual internal scarring.
- £750,000 settlement for alleged failure by GP to control hypertension leading to stroke and permanent neurological deficit.
- £44,000 received by the claimaints following the death of their four-day-old daughter who died in March 2008 following the defendant healthcare trust's negligent failure to have delivered her earlier as she was in clear fetal distress and was born in a very poor condition. The parents suffered psychological injuries including post-traumatic stress disorder and an adjustment disorder.
