Severe gum disease goes undetected
The Claimant regularly saw the Defendant for treatment over many years. Upon seeing another dentist he discovered that he was suffering from severe periodontal (gum) disease. The Defendant had not taken sufficient radiographs to detect that he had decay and had placed unsatisfactory restorations over the decaying teeth. The Claimant required extensive restorative treatment.
Settlement: £25,000
Negligently installed bridgework
The Claimant was alarmed to discover that decay had set in around his dental bridges. Investigations revealed that the Defendant had negligently installed ill-fitting bridges, which had been attached to inadequately strong teeth. The Defendant also failed in his duty of care to carry out radiographs and vitality testing to ascertain the strength of the bridge supporting teeth. The Claimant required painful and costly treatment to replace the bridges and treat the damage caused by the decay.
Settlement: £48,500
Removal of mercury fillings
The Claimant suffered with ME. She believed there was a link between her health problems and her mercury fillings. The Defendant replaced the fillings with composite resin fillings, in all four quadrants of her mouth over a very short period. He failed to carry out a pre-treatment plan and did not take x-rays. As a result of negligent dental treatment, the Claimant suffered with jaw pain, joint dysfunction and irreversible pulpitis (inflammation of the inner part of the tooth). If the claimant had been advised about the tenuous link between mercury fillings and health problems she would not have elected to undergo treatment
Settlement: £25,000
Long-term neglect leads to extensive decay
The Claimant was treated by the Defendant over a 20 year period, during which time the Defendant failed to monitor or treat him properly. The Claimant was later found to have gum disease and tooth decay which required corrective treatment including 10 fillings, 4 root fillings, 2 crowns and 2 extractions. There remained a risk that the Claimant would require further treatment and a claim for the cost of future treatment was incorporated into the settlement.
Settlement: £19,000
Inappropriate root canal treatments
The Claimant received treatment from the Defendant over 11 years, during which time she received 7 root treatments. The Defendant failed to properly investigate the cause of her pain, failed to interpret x-rays appropriately and filled teeth with inappropriate materials (silver points). He also failed to discuss treatment options with the Claimant. She lost a number of teeth prematurely and is left with future treatment needs.
Settlement: £10,000
