Overview

Hospitals, as the media is keen to make us aware, are neither as safe nor as clean as they have been in the past. Mistakes are made in hospitals and in the care of patients outside hospital. It is a fact that, sadly, some of us or our families will fall victim to these mistakes.

Withy King’s clinical negligence specialists comprise an experienced team, dedicated to helping victims of all types of medical accidents. We understand that cases of this nature are emotive. We also know that they must be dealt with sensitively, professionally and efficiently. The accolades we receive from our clients show that not only are we good at what we do, but that we genuinely act in our clients’ best interests.

In this complex area of law, specialist advice is vital. We are proud to be one of the few firms in the South West to have been awarded a Clinical Negligence Specialist Quality Mark by the Legal Services Commission. This prestigious appointment reflects the level of competence and expertise within our clinical negligence department.

The Withy King clinical negligence department is described in ‘The Legal 500, A Client's Guide to the UK Legal Profession’ as an "extremely highly rated group". Five of its members, Simon Elliman, Gerry Ferguson, Paul Rumley , Jane Measures and Richard Coleman are on the Solicitors' Regulation Authority's specialist clinical negligence panel, and three are on the Action against Medical Accidents (AvMA) referral panel. Simon Elliman and Gerry Ferguson have also been selected as Legal Experts in Clinical Negligence by 'Legal Business', as well as in the Chambers Directory guide to top law firms.

In effect, our internal systems and extensive database of experts have received an official seal of approval. It also means that, where a case justifies it, and funding is available, we can obtain public funding for your case.

If you, or someone close to you, have suffered injury or loss as a result of inadequate or negligent medical or dental care, a misdiagnosis, or because you were given inappropriate treatment, it may be possible to make a claim. We understand that money cannot always fully compensate the injured or their carers, but it can help to improve quality of life, particularly in the case of a birth injury. Find out more about birth injury and cerebral palsy claims.

We will deal with your case expertly and efficiently. Please click on the links to find out more about our services and the answers to your questions regarding funding and the claims process. We will be happy to arrange for one of our team to give you free initial advice at one of our offices or on the telephone. Home visits can be arranged, if necessary.

Our service does not stop with the award of compensation.  We work with you to ensure that your compensation does not affect your entitlement to any benefits you might be receiving.  We also assist in organising the carers, therapists, aids and equipment that can make all the difference. We have strong links with many support agencies and charities such as Headway, Scope and the Child Brain Injury Trust.

For a free initial assessment of whether you might have a valid claim, complete our short online enquiry form.
