FAQs - Frequently asked questions about Collaborative Practice

Collaborative Law is an exciting development in matrimonial practice which we believe may transform the process of resolving family problems.

Many people (experts and lay people alike) believe that the forensic process is not the most suitable way of solving your family’s problems. It is cumbersome, can be very expensive and there is no guaranteed outcome - because the final decision depends upon the manner in which a single individual (the Judge) exercises discretion in applying the relevant legislation. The process is stressful and often there is no winner. Frequently both parties are dissatisfied with the result and the length of time it has taken to obtain it.

Collaborative Law offers a solution to these problems. You and your partner instruct a specialist lawyer and you all sign up to an Agreement not to go to Court. You agree to act in good faith and do what is best for the family. You have to recognise that this involves making concessions - some of which are not palatable but are for the good of your family. Together the group works to reach a solution that everybody finds acceptable. It is not easy. It may not be suitable for every case but it gives you the chance to solve your problems. We believe that this is the only way to achieve a lasting solution. With luck, everybody retains their dignity during the process and ends up reasonably satisfied.
