 When a marriage fails, there are bound to be concerns about financial security. Both parties will want to ensure that they have sufficient assets to house themselves and the children.

Our highly experienced team will analyse your particular circumstances carefully and provide you with clear, objective advice about your position and an appropriate solution for you. This can be done with the assistance of mediation or by negotiating with the legal advisors instructed by your partner or through Collaborative practice.

The court can make a wide variety of orders when asked to resolve such questions, including provision for maintenance, transferring property from one partner to another and for ending the financial obligations of the parties to each other.

The court aims to achieve a fair solution, and looks at the current and future financial needs of all the parties, but the welfare of any children is paramount. It is not always possible to predict exactly what a court will decide, and we encourage clients to seek a negotiated agreement if possible and to consider mediation to achieve that.
