Motor Insurers' Bureau (MIB)

The MIB was established in 1946 as a private company limited by guarantee for the purpose of entering into Agreements with the Government to compensate the victims of negligent uninsured and untraced motorists. Every insurer underwriting compulsory motor insurance is obliged, by virtue of the Road Traffic Act 1988, to be a member of MIB and to contribute to its funding.

The fact that a negligent third party driver is uninsured or cannot be traced after an accident is therefore not necessarily a bar to recovering compensation for an injured motorist or passenger.

Withy King can offer advice based on experience of the following:

  • Compensation through applications to the Motor Insurers’ Bureau (MIB) relating to uninsured or untraced drivers.
  • MIB Appeals (both in terms of the liability of the MIB to compensate and the level of that compensation)
  • Professional negligence actions against solicitors for their failure to advise an application to the MIB
