Social changes in recent years have had a huge effect on families and these changes need to be reflected in the Wills people make.
A surprising 74% of the UK population does not have a Will. Without one, your assets can go to someone that you do not want to benefit and claims may have to be made against your estate by someone who was living with you or being maintained by you.
To add to this, comparative decreases in tax thresholds and increases in property values have resulted in fears that beneficiaries will have to pay significant amounts of inheritance tax following the death of relatives. These issues can often be solved (or at least helped) by the Will-making process.
Just as Executors are responsible for carrying out the wishes expressed in your Will after your death, you may wish to consider drawing up a Lasting Power of Attorney (LPA), which allows you to appoint someone to act on your behalf in case, in the future, you are unable to manage your own financial affairs due to incapacity.
You may also make a separate LPA to cover personal welfare decisions. This must contain provisions specifying whether your attorney is to have authority to give or refuse life-sustaining treatment on your behalf if you lose capacity.
Once created, your Will should be reviewed every few years. Not only does the law and tax rules change but so might your personal and financial circumstances.
