Call for feedback on Law Commission Report

Withy King Solicitors has launched a survey to gauge lawyers’ views on the Law Commission’s Report on Intestacy and Family Provision Claims on Death.

The in-depth feedback survey, which will earn respondents one CPD point when completed, was presented to a group of 26 solicitors at an event held in Bath last week.

Amanda Noyce, head of Contentious Trusts and Probate at Withy King who is leading the initiative, said: “Not many practitioners are fortunate enough to be involved in many cases which actively change the law. This is a once in a career opportunity to influence a change to the law.”

The Inheritance (Provision for Family and Dependants) Act 1975 has remained largely unchanged for 35 years.  Likewise, the most recent significant change to the intestacy provisions took effect on 1 February 2009 and only sought to amend the amount of the statutory legacy. The Law Society is currently in consultation over the proposed changes which are designed to acknowledge modern family structures. 
 

The closing date for the receipt of completed surveys is Friday, 19 February; this will enable the feedback to be collated and submitted before the end of the consultation period on 28 February.
