If you are a landowner you will want to maximise the value of your land. There may be an opportunity to generate extra income by utilising your mines and minerals rights benefitting your land or granting a licence to allow landfill waste on your land but achieving it can be far from straightforward. These areas are complex and subject to onerous UK laws and European legislation that is constantly changing and may put your plans at risk. 

When it comes to the commercial contract, we will guide you through the use of royalty payments while the land is worked and the grant of appropriate rights on completion of the works to restore the land. If you are a landowner, we can review with you the different approaches to ensure  appropriate security is in place until  the restoration phase is complete.  If you are an operator, you will want to  ensure that this risk is fairly apportioned without being financially onerous.

Planning and environmental requirements are particularly detailed and potentially onerous for operators and landowners. We are able to work with your specialist consultants to look for appropriate solutions to these requirements. You may require advice on the granting or taking of land options or the registration of your rights to the mines and minerals below the surface of the land in question.  Unless these rights are formally protected before 13 October 2013, there is a risk these rights will be lost and you may need to start taking urgent action.
