No-one likes to think that they or anyone in their family will ever lose their mental capacity, whether through illness, injury or simply advancing age.
It’s a sad fact that, as life expectancy increases, so does the likelihood that this could one day become a reality. Loss of capacity and its effects are distressing and frightening, both for the individual affected and their family. The uncertainty is worrying, but by accepting the possibility and preparing for it in advance, some of that worry can be relieved. Taking steps now to prepare a Lasting Power of Attorney gives you peace of mind that your affairs will be managed should the need arise, or you may already have set up an Enduring Power of Attorney.
Loss of capacity may already be a reality in your life, perhaps with an elderly relative showing early signs of dementia, or you may be caring for someone with serious illness or injury. How can you best help this person with their money and other personal affairs? It may not necessarily be too late to put a Lasting Power of Attorney in place but, if this is not possible, you may need to consider appointing a Deputy to protect the individual through an application to the Court of Protection.
